San Berdo BK!

The domino's are in motion.  California is in dire shape as we see these bankruptcies take off.

HERE is the article.

We are seeing this mess down to the local level.  We have a dysfunctional state where the dysfunctional federal system has finally come home to roost.   When our state has a 16 billion dollar deficit (some say twice that), and yet the kids under the Capitol dome still vote to dump 65 billion dollars (57 billion in deficit)  for a high speed rail on the bond market, we taxpayers/citizens are simply screwed.  How do we explain this utter disregard for reality?  Is there something in the water in Sacramento that makes the kids delusional?

It is time to regroup.   I do not see a fix other than what we now see sweeping the state.  Bankruptcy may be the only way to redo all those contracts passed over the years with the unions and the pension systems.  Without income to match the expenditures, without jobs and taxpayers, without freedom to innovate because of suffocating rules and regulations, we see first hand the results of those follies of government.  Demise of our system.  But we see a total disregard at all levels of government in California.  We see the piling on of more and more rules everyday.  We see the upper push of more fees and taxes to backfill the shortfall created by the very policies put in place by the kids under the dome and local governments.

How can we fix it?  I think the only way to fix the mess is to "blow up the boxes" of conventional thinking exhibited and practised by our politicians and the systems they have put in place.  It is not working and many of us who saw this coming in the early 80's can now say "we told you so"!

I watched Mittt Romney at a townhall last night on CSPAN.  One of the questions an audience member asked was when will the mandates without funding stop?  We at the local level said that 30 years ago but no one above the local level gave a rat's ass and they just kept passing more and more laws tying up and taking away our local freedom to spend our money on our priorities.  This has in its own way, made America equal in that the whole system is in jeopardy because the federal system has been out of control.  This was mostly because the courts said the Commerce Clause makes anything and everything the feds want the Supreme law of the land.  The Tenth Amendment was trashed and programs like the EPA and EEOC and so many other federal laws were to be implemented even though we did not want them.

The rules and the unions and civil service have brought America to its knees and we see the results.  Cities like San Bernardino and Stockton are kaput, both are the canaries in the mine!  So if we want to survive as a country and have a economy of progress we must get the government out of the everyday lives of each of us.  Return to the enumerated Constitution at the Federal level and at the state and local level, adjourn the Legislature and don't come back for a couple of years.  Return the ability to fire bad employees and have citizen panels to mediate decisions of government employees and mandates.  We can't rely on the government to do the right thing anymore and we have to return to the basics of governance if we want to survive as a country.

  2. Well Celeste. It seems that is the lopey excuse for those who don't know squat. When you build a subdivision in California you pay IN ADVANCE, the fees to all the agencies and are required to build all your infrastructure, roads, water, sewer etc. before you can get a white paper to sell one lot or house. So, since all the money was paid to the government in advance, who controlled the expenditures? Could it be the local city governments? Yep. So,if you were right, Grass Valley and Nevada City, both not having any permits of note for many years, should be doing just fine. Please review your comments before you embarrass yourself in the future.

  3. My statement is 100% accurate. Both cities had documented real estate bubbles in greater percentage than almost anywhere else in CA.

    2. ??? Not related. They aren't on the verge of bankruptcy, partly because they did NOT aggressivley overbuild and create unrealistic budgets. Not excusing the City planners in those bankrupt cities who bought into the double digit growth in housing, the economy and tax revenues.

  4. Don't go blaming "real estate". Start with LIB Big government and stating home ownership was a "right".( yes, IF you can afford it) LIBS dreamed up the sub prime loan garbage. The banks wouldn't have loaned to people that they knew couldn't pay it back, but LIB government guaranteed those "loans". Now you see the mess that's created.
    When it comes to subdivisions or any other "planned community" From 3 homes built to ( name your number),,, Who ever is doing the building eats the full cost of the infrastructure. From the grading, paving, sewer, water, phone, power, catv, etc. When ALL the inspections are done everything is turned over to the governing body. Be it city or county. Only then does the city or county start picking up the tab for upkeep. Cities and Counties don't pay squat for any new construction. They just send bills and inspectors.

Oh, and before a subdivision is even started, construction wise, the developer spends millions to hire mandated consultants to study every little thing and do EIR's. That employs a whole lot of folks and that doesn't even count the fees the government charges for the right to build on our own property.

    2. And abandoned developments help create budget deficits in Cities, and they breed crime which drives out other taxpayers and business revenues. Abandoned developments played a significant part in these problems, facilitated by dumb people running the governments in these towns who built their projections on 15% annual growth.

  5. Who said real estate was the only reason for those BKs? I would assert that it certainly hastened the situation in those overbuilt communities. Both of you doth protest too much. The developers do not pre-pay all the years of projected property taxes that the admittedly naive/dumb/possibly corrupt governments used in their projections and expenditures.

    1. Prepay property taxes? Actually they do. They pay for the first batch before they sell the houses. So you are once again incorrect. We are not protesting too much, we are pointing out the theft of your money as well as all the prepaid money and infrastructure constructed and turned over to the government.

      Not sure what you are still contesting. Seems you and Walt are incredibly defensive about any mention of developers and real estate. Stockton and San Bernadino were severely overbuilt. That is a FACT. And it contributed to their fiscal problems when the developments and future budgets went abandoned.

    Yes, government over spending is the number one reason. And Progressive Gov. Brown is doing exactly that. Spending future money we don't have, and counting on us to vote for higher taxes.( NOT going to happen)

    So do you have your (projected)property taxes prepaid for the next five years? Somehow I don't think so. ( do you even OWN property? If you did, you wouldn't be making such wild statements)

Walt, now that the numskulls in Sacramento (democrats) have decided to start the high speed rail from nowhere to nowhere, and it is 58 billion underfunded to boot, California has once again shown the inmates are running the asylum. All that bond money has to be paid back and end the end, every dollar spent on the train to nowhere is deducted from education and help for the poor.

    Was simply pointing out that the first bankrupt cities happened to be two of the most overbuilt towns in CA when the bubble burst. Yes, Cities used those future property tax receipts in the projections and budgets. All Cities use future property tax projections, but these two places were some of the most unrealistic in their figures. Mammoth's filing was due to a real estate developer who chose not to mediate its $43M lawsuit, but rather win at any cost- and let Mammoth Lakes go bankrupt. Nice people...or are corporations people...

    2. Same basic issues as the other towns. It most certainly occurred after the bubble burst in 2008. Home values plummeting definitely played a role in their demise. And yup, their government was apparently totally blind to a possible fiscal collapse.

  8. I'm not hip to what went down in Mammoth. So the city wanted to weasel out of paying a debt? Say it ain't so!!! That sure sounds familiar. ( ATPACK ring a bell?)
    How much did that cost our own County taxpayers?
    Cry me a river about pooor ol' Mammoth... If it was the other way around, do you think the city would "forgive" any amount of money it felt it was owed? LOL!!!!

    All I see out of you is "developer" bashing. I happen to do that kind of work. They are the ones that write me checks that put food on the table, and gas in my tank. It's people like me that built the roof over your head, the road you drive on, and put the pipes in the ground so you have indoor plumbing.
    I also know exactly who to blame in all this mess too. And it's NOT the speculative home builders. It's the ones who wrote the laws on real estate financing.

    3. Maybe if Mammoth had lived up to it's agreements, they would still be solvent. They got the upgrades to the airport then back out on their end of the deal. Funny how the developer haters fail to mention the backstabbing city's role in all this.

      That would be like IMM installing all new water lines as part of an agreement to allow them to start mining, then the city of GV stating, "sorry, we changed our mind. Thanks for the water line, and NO , we won't pay for that either,,, sucker"

    You could have easily predicted the first bankruptcies in CA cities by the FORECLOSURE rates, ie- housing fiasco, overbuilding bubble. Vallejo certainly WAS a real estate bubble city, which had a lot to do with their troubles. Yup, greedy developers were certainly part of the problem.

    Your poor little city of Mammoth got what was coming. Mammoth is the bad guy NOT the developer. Now Mammoth is the one shirking on it's obligation to pay up by filing BK.

    It must suck to have your own "evidence" used against ya'.
    Don't spend what you don't have, and don't make deals you can't or won't live up too.

    1. I would argue that developers are all in for greed and maximum profit, and don't really care about sustainability of communities. Otherwise, they would have compromised and sat down to work out a solution in Mammoth. Just like the Tea Party- unwilling to talk and work for solutions with people who aren't like minded. Gotta work with the other half.

    2. So tell us Celeste, what exactly is building a house all about? Is it shelter for the occupants from the sun and the rain? Is it an investment tp the pwners? How about a place that supplies stability for a family and for parents to raise their kids. Who acrtually supplies the money to do a development? Since all the roads and other infrastructure are supplied before a developer can sell a lot or a house, how is that anti-sustainable? I have really got an interest in the answers.

      Regarding the Tea Party. I am not a member of one but can you tell us where you disagree in their three pronged manifesto? One is a balanced budget, two is follow the Cinsyiyuion and three. respect for our country. Which one's do you disagree with? Since you are aliberal, I know you will not answer these simple questions but if for some reason you go against the liberal grain and really respond Jeff, I am all ears.

    1. I have re-negotiated for lower rents a few times in my past. Um, I got pretty far, Walt. A lot of apartment complexes where I lived were happ to give all sorts of concessions to keep a tenant for another year or two, in the face of too many apartment units being built in cities that overbuilt. Seems like that was a real problem all over America.

But unfortunately, you're not the manager of a sprawling apartment complex in a sea of spanking new and sprawling apartment complexes in a Southeast boom town- where they were literally giving away 3 or 4 free months for a 2 year renewal. Some of us have been around and seen different parts of the world and our country. Its quite diverse Walt. And the name is not Jeff.
